Man jailed for killing Spotted Eagle Owl on Sea Point Promenade

The Cape of Good Hope SPCA has welcomed the conviction and sentencing of Gustigu Mthini, a 38-year-old Mozambican national, who was found guilty of animal cruelty and wildlife law violations following a brutal attack on a protected Spotted Eagle Owl on the Sea Point Promenade earlier this year.

The shocking incident, which occurred on 16 February 2025, was captured on video and sparked public outrage.

In full view of passersby, Mthini emerged from nearby bushes and savagely beat the owl with a stick, causing multiple fractures.

The owl later succumbed to its injuries.

Following a joint investigation by the SPCA’s Chief Inspector Jaco Pieterse and Sea Point City Improvement District (CID), Mthini was tracked down and arrested six days later.

He remained in custody for seven months until the conclusion of his trial in September.

Convictions and Sentences

Mthini was found guilty on four charges:

  • Animal cruelty (Animals Protection Act 71 of 1962)
  • Two counts of killing a protected species (Nature Conservation Ordinance 19 of 1974)
  • Contravention of immigration laws (Immigration Act)

Sentencing

  • Count 1 (Animal Cruelty): R2 000 fine or 2 months’ imprisonment, wholly suspended for 5 years
  • Counts 2 & 3 (Protected Species): R3 000 fine or 3 months’ imprisonment each, wholly suspended for 5 years
  • Count 5 (Immigration): R2 000 fine or 2 months’ imprisonment, with 1 month suspended

Mthini will serve 1 month in prison under the Immigration Act and will be deported to Mozambique upon completion of his sentence.

SPCA Response

SPCA Chief Inspector Jaco Pieterse hailed the conviction as a “victory for the animals we serve and protect.”

“Animal cruelty has no place in our society. This outcome sends a strong message that those who harm animals will be held accountable,” Pieterse said.

The SPCA extended its gratitude to the Sea Point CID and Chairperson Jacques Weber for their vital role in the arrest and investigation.
